Under the Agreement, the Service Provider shall provide access to the Course and the Course Materials and, upon successful completion of the Course, issue a Certificate; the User shall pay the Registration Fee and the Tuition Fee. The detailed rights and obligations of the Parties are governed by these GTC.

10.

The User shall provide the Service Provider with true, accurate and up-to-date information necessary for the conclusion and performance of the Agreement. The Service Provider shall not be liable for any damage, error or delay attributable to information provided incorrectly, inaccurately or without authorisation.

11.

The User shall keep confidential the login credentials for the online Course platform and shall not disclose them to any third party. Each person may use the Course through only one active user account. Neither the user account nor the right to participate in the Course may be transferred.

12.

The User may apply the knowledge obtained during the Course only within the scope of the User's own competence and in a manner consistent with the User's qualifications. Unless otherwise provided by the laws of the country in which the User actually carries out professional activities, successful completion of the Course does not entitle the User to practise as a psychologist or to administer psychological tests.

13.

To use the Course, the User shall, at the User's own expense, provide an adequate internet connection, an electronic device, an email account and the use of the electronic communication tool designated by the Service Provider that enables the simultaneous, real-time transmission of audio and video required for online consultations.

14.

The Service Provider shall not be liable for access or communication problems resulting from the lack and/or incorrect configuration of the User's device, internet connection or email service, or from a fault in a service operated by a third party. The Service Provider further excludes liability for damage and other losses caused by harmful content, including viruses and malware, transmitted through or made available by use of the Website.

15.

The Service Provider may temporarily restrict the operation of the Website, the Course Materials or the Software during the term of the Agreement for maintenance, security incident or another technical reason. The Service Provider shall endeavour to inform the User in advance of planned maintenance involving downtime.

16.

The Service Provider does not guarantee that the User will achieve any particular academic, professional, business, financial or personal result, even upon successful completion of the Course. The practical application of the knowledge acquired through the Course is the sole responsibility of the User. The User is responsible for complying, when applying the knowledge and methods presented in the Course, with all laws, regulations and rules of professional ethics applicable to the User's activities, profession and processing of personal data, and to the rights of any third parties affected thereby.

17.

The Service Provider excludes liability for any damage caused to the User or any third party through the User's unlawful or unprofessional application of the knowledge, Course Materials or Software provided by the Service Provider, or through their application beyond the scope of the User's competence.

18.

The Service Provider shall not be liable for any failure or delay in performing its obligations resulting from a circumstance beyond its reasonable control that was unforeseeable at the time the Agreement was concluded and could not reasonably have been avoided. In such a case, the Service Provider may suspend or reschedule performance.

V. Registration and Conclusion of the Agreement

19.

The Agreement is concluded upon successful registration. Registration takes place by completing the relevant electronic form on the Website and expressly accepting the GTC.

20.

A further condition of successful registration, the conclusion of the Agreement and participation in the Course is that the User pays the Registration Fee at the same time as registration, using the method specified on the Website. The Registration Fee shall be deemed paid when the full amount has been credited to the Service Provider's account.

21.

The Service Provider shall send electronic confirmation of successful registration and payment to the email address provided by the User. The User shall verify the contents of the confirmation and notify the Service Provider of any error without delay.

22.

The conclusion of the Agreement is evidenced by the electronic declaration accepting the GTC, the data saved at the time of registration, the confirmation and the payment records.

23.

Following successful registration, the Service Provider undertakes to reserve the User's place on the relevant Course for a maximum of fifteen (15) days from confirmation of successful registration (but no later than the third day preceding the advertised commencement date of the Course). This period is intended to allow the User additional time to pay the Tuition Fee for the first semester. If the period under this Clause would expire later than the third calendar day preceding commencement of the Course, the deadline for payment of the Tuition Fee for the first semester shall be the third calendar day preceding the commencement date of the Course. If this deadline is missed, the Service Provider shall issue a final notice granting a supplementary period of at least seven (7) days. If the User fails to make payment within that supplementary period, the Service Provider shall be entitled to terminate the Agreement with immediate effect.

24.

If performance of the Agreement (for example, delivery of the Course) fails due to a fault of the Service Provider, the Service Provider shall refund the Registration Fee received. If the User is responsible for the failure of performance (for example, because the User does not study the Course Materials, or does not pay the Tuition Fee by the applicable deadline), the User shall forfeit the Registration Fee and shall not be entitled to a refund. If performance fails for a reason for which neither Party is responsible, or for which both Parties are responsible, the Registration Fee shall be refunded.

VI. Subject Matter and Structure of the Course

25.

The Service Provider's objective is to provide, through the Course, educational materials on psychology that assist the User in expanding and developing knowledge in the field of drawing assessment and drawing interpretation. The title, the specific topics covered in the Course and the planned schedule are available on the Website, in the course data sheet: https://sscamethod.com/course-data-sheet/ (name and hours of the Course, planned start and end dates, schedule by unit).

26.

The Course consists of two semesters followed by a final paper. Each semester lasts twelve weeks and is intended for studying the Course Materials. After passing the exam, the User prepares the final paper. The Service Provider may offer an optional third semester for further study at a separate price; it is not required for completing the Course or obtaining the Certificate.

27.

During the first and second semesters, the Course Materials (including, in particular, pre-recorded video lessons and related supporting materials) shall, as a general rule, be made available to the User weekly according to a schedule determined by the Service Provider through the relevant interface of the Website. The User shall study the Course Materials already made available independently and according to the User’s own schedule. The Service Provider shall not monitor the User’s study of the Course Materials and shall not impose any sanction for failure to study them, except in relation to the examination and the final paper.

28.

In each of the two semesters, the Service Provider shall offer the User an opportunity to participate in live online group consultations at intervals determined by the Service Provider. The Service Provider shall determine the date, timing, duration, technical platform and procedure for the consultations and shall inform the User thereof.

29.

The consultation opportunity may be used at the time designated by the Service Provider. The User shall not be entitled to a replacement consultation, an individual appointment or a refund in respect of any consultation missed for any reason, including a technical impediment on the User's side. In justified cases, the Service Provider may change or postpone a consultation after giving the User prior notice.

30.

As part of the Course, the User shall be given access to the Software for the term of the Agreement from the date and subject to the conditions determined by the Service Provider. Access to the Software is a personal entitlement linked to the Course; the User may not transfer it to any third party or permit any third party to use the Software.

31.

The Service Provider may freely modify substantive, methodological or technical elements of the Course, the order in which the Course Materials are released, the consultation arrangements and the technical solutions used for the Software, provided that such modification does not prejudice the purpose of the Course or the User's rights.

VII. Completion of the Course

32.

At the end of the second semester, the User shall take an exam. A prerequisite for taking the exam is the completion of the first two semesters. The Service Provider may determine the detailed technical and assessment conditions of the exam at its own discretion, provided that it shall communicate the exam requirements and technical conditions to the User in advance and in good time. The exam is passed if the User achieves a score of at least 60%. The User may attempt the exam three times; after that, the User may take an oral retake with the professor. No exam fee will be charged.

33.

After passing the exam, the User shall prepare a 5-10 page case study as a final paper, demonstrating the independent application and competent interpretation of the methods learned in the Course within the User's own sphere of competence and in compliance with the applicable ethical and data protection rules.

34.

Participation by any third person assessed in the final paper must be voluntary. The User shall ensure that the necessary information is provided, the necessary consent is obtained and any data permitting identification is properly anonymised. The Service Provider may reject a paper that is unlawful, ethically objectionable, prepared using artificial intelligence or otherwise not prepared independently.

35.

The final paper is passed if it is accepted by the Service Provider. If the final paper is unsuccessful, the Service Provider shall provide the User with a written assessment of its deficiencies within thirty (30) days. The User may correct the deficiencies and resubmit the final paper on one occasion. Resubmission is permitted within thirty (30) days after receipt of the written assessment, but no later than the expiry of the period available for completion of the Course.

36.

The Course shall be deemed successfully completed if the User:

a)

has completed both semesters;

b)

has paid in full all Registration Fee, Tuition Fees and any other fees due;

c)

has passed the exam following the second semester;

d)

has submitted the final paper by the applicable deadline and the Service Provider has accepted it.

The User has one year from successful registration to satisfy all the above conditions. Upon expiry of this period, the Agreement shall automatically terminate; however, at its own discretion and by way of individual equitable consideration, the Service Provider may, upon a reasoned request from the User, grant an extension or an opportunity to make up or repeat a requirement.

37.

Upon successful completion of the Course, the Service Provider shall issue a Certificate to the User. The Certificate does not constitute a state-recognised or accredited qualification and, unless otherwise provided by the laws of the country in which the User carries out professional activities, does not in itself entitle the User to hold a position, practise a profession or carry out a regulated activity.

VIII. Fees and Payment Terms

38.

The Registration Fee, the Tuition Fee for each semester, any available instalment schedule, the currency, applicable taxes and payment methods shall be displayed on the Website and in the order summary shown before payment. Scholarships are not available for the Course, and no state budget or European Union funding is used for the Course.

39.

The Tuition Fee for each semester shall become due and payable separately. The Tuition Fee for the first semester shall be due in accordance with Clause 23; the Tuition Fee for the second semester shall be payable within fifteen (15) days after completion of the preceding semester (that is, after all Course Materials for that semester have become accessible and, where the semester concludes with an exam, the exam has been passed). If this deadline is missed, the Service Provider shall issue a final notice granting a supplementary period of at least seven (7) days. If the User fails to make payment within that supplementary period, the Service Provider shall be entitled to terminate the Agreement with immediate effect.

40.

Access to the Course Materials for a particular semester is conditional upon full payment of the Tuition Fee for that semester or upon the User undertaking an obligation to pay the Tuition Fee for that semester in full by instalments. This includes the first week's Course Materials for the first semester. Following successful registration, the Service Provider shall make one sample lesson available to the User free of charge.

41.

The Service Provider may offer the option of paying the Tuition Fee for a semester in instalments. Where payment by instalments is selected, the total amount payable may be higher than the amount payable in a single payment; the Service Provider shall clearly display this information on the Website before payment. By selecting payment by instalments, the User undertakes to pay the full Tuition Fee for the relevant semester. If the User pays the Tuition Fee for a semester already commenced by instalments and is late with any instalment, the entire outstanding balance of the Tuition Fee for that semester shall become immediately due and payable in a single amount.

42.

If the User fails to meet any payment obligation (including failure to pay any instalment applicable to an instalment plan), the Service Provider may – after a final notice – suspend the User's access to the Course, Course Materials, Software and any other restricted online interface, and may reject any subsequent registration by the User, provided that the failure to meet the relevant payment obligation does not result in termination of the Agreement.

43.

The Service Provider shall display the total price of the Course on the Website, in the course data sheet: https://sscamethod.com/course-data-sheet/. The individual fee components comprising the total price are set out in the detailed price list available on the Website. All fees, including the Tuition Fee for the second semester, shall be payable in accordance with the price list published on the Website and in effect at the time the Agreement is concluded.

44.

Payment may be made by bank card, bank transfer or any other method displayed on the Website. In the case of payment by bank card in instalments, the User authorises the automatic charging of instalments when due by granting the relevant authorisation through the payment interface.

45.

The Service Provider shall issue an electronic invoice or another receipt compliant with applicable law in respect of each payment made and shall deliver it to the email address provided by the User.

46.

The Tuition Fee, any instalment thereof, or any other fee paid by the User under the Agreement shall be deemed paid when it is credited to the Service Provider's bank account.

47.

Registration does not oblige the User to complete the Course or to pay the Tuition Fee for every semester. However, subject to mandatory provisions of law, a Tuition Fee already paid or undertaken to be paid by instalments shall not be refunded or waived solely because the User does not actually use the Course Materials, does not participate in a consultation or exam, or does not complete the Course.

IX. Termination of the Agreement

48.

The User may terminate the Agreement at any time, without stating reasons, by giving notice to the Service Provider. The User’s right of termination may not be restricted or excluded. Termination shall take effect when the notice is received by the Service Provider and shall not affect payment obligations proportionate to services duly performed before termination or any rights arising from an earlier breach of the Agreement.

49.

The Service Provider may terminate the Agreement with immediate effect if the User:

a)

is in default with a payment obligation after a final notice;

b)

discloses access or login credentials to a third party;

c)

copies, distributes or makes the Course Materials or the Software available without authorisation;

d)

provides false information to the Service Provider;

e)

otherwise commits a material or repeated breach of the Agreement.

50.

The Agreement shall terminate:

a)

upon successful completion of the Course;

b)

upon termination by either Party;

c)

upon lawful withdrawal from, or termination of the Agreement by a User qualifying as a consumer under Government Decree 45/2014 (II. 26.);

d)

upon expiry of the fixed term of one year from successful registration, unless the Service Provider exercises equitable discretion under Clause 36;

e)

in any other case specified in these GTC.

51.

Upon termination of the Agreement, except where it terminates upon successful completion of the Course, the User's access to the Course, Course Materials, Software and any other restricted online interface shall also terminate automatically.

X. Access to Course Materials Following Successful Completion

52.

If the User successfully completes the Course, the User's access to the Course Materials and the Software shall not terminate automatically upon completion of the Course and termination of the Agreement. However, continued access does not constitute a guarantee of access for the User's actual lifetime, a perpetual licence, or an undertaking by the Service Provider to maintain the Course Materials, Website, Software or any particular technical solution unchanged for an unlimited period.

53.

After successful completion of the Course, the Service Provider may, for reasonable cause - including a change in law or a professional, security, licensing, technical or economic reason - modify, update, supplement or reduce the accessible Course Materials, the Software or the technical means of access.

54.

The Service Provider is not obliged to maintain earlier versions of the Software, compatibility with particular devices or operating systems, or technical support for an unlimited period. The Service Provider shall provide any security and compliance updates required by law in accordance with the applicable mandatory rules.

55.

Even after the Agreement has terminated following successful completion of the Course, the Service Provider may restrict or terminate access to the Course Materials and the Software if the User uses them without authorisation, shares login credentials or otherwise breaches the Agreement, or if restriction or termination of access is justified by a legitimate economic, technical or other reason arising within the Service Provider's sphere of interest.

XI. Consumer's Right of Withdrawal and Termination

56.

A User qualifying as a consumer may withdraw from the Agreement without giving any reason within fourteen (14) days from the date on which the Agreement was concluded or, if access to the Course Materials, the Software or any part thereof has been provided within that period, may terminate the Agreement.

57.

The User may exercise the right of withdrawal or termination by making an unequivocal statement addressed to the Service Provider. The statement may be sent by post or electronically to the contact details specified in these GTC.

58.

The deadline shall be deemed met if the User sends the withdrawal statement before expiry of the fourteen-day period.

59.

In the event of a valid withdrawal or termination, the Service Provider shall refund the refundable amount within the period prescribed by law, as a general rule using the same means of payment as that used for the original transaction. No fee shall be charged for the refund.

60.

Under the Agreement, the Service Provider supplies the User with digital content not supplied on a durable data-storage medium. Accordingly, the User's right of withdrawal shall cease when the Service Provider begins performance with the User's express prior consent and the User simultaneously acknowledges that the User thereby loses the right of withdrawal, provided that the Service Provider has supplied the confirmation required by law.

61.

The Website, Course Materials and Software are protected by copyright, industrial property rights and other intellectual property rights. The Service Provider is the holder or authorised user of those rights.

62.

Unless expressly permitted by the Service Provider's prior written consent, any unauthorised use, adaptation, reproduction, partial or complete distribution, copying, replication, public performance, communication to the public, publication, extraction or use for revenue-generating activities of the Website, Course, Software or Course Materials is prohibited.

63.

The User may view and, where technically enabled by the Service Provider, download or print the Course Materials solely for the User's own study purposes and only to the extent necessary for their intended use. Downloading does not confer ownership or any further licence to use the Course Materials.

64.

The User is prohibited from sharing with any third party the User's personalised login credentials or password providing access to services and content operated through restricted access on the Website (including, in particular, the Course Materials), or from making them available on any public or restricted forum, social media platform, content-sharing website, file-sharing system or other online interface.

65.

In the event of a breach of this section, the Service Provider may seek cessation of the unauthorised use, injunctive relief, restitution of any enrichment obtained through the infringement, damages, compensation for non-pecuniary harm, termination of access and any other remedy available under the applicable law. The Service Provider may also terminate the Agreement on the grounds of material breach and terminate the User's access to the Course and Course Materials without separate notice or demand.

XIII. Data Processing

66.

The Service Provider shall process personal data in accordance with applicable data protection laws and the Privacy Notice available on the Website. For the purpose of conducting the Course and complying with its statutory reporting obligations, the Service Provider shall process the User’s natural identification data, educational identification number where applicable, email address, highest educational qualification, and data relating to participation, completion, assessment and payment obligations, and shall transmit the data required by law to the Hungarian Adult Education Reporting System (FAR). Such processing is based on compliance with a legal obligation and does not require the User’s consent. The Service Provider shall retain the relevant data and training documentation for the period prescribed by law, including the period required by Act LXXVII of 2013 on Adult Education.

67.

The User shall refrain from unnecessarily disclosing, in the final paper, during a consultation or in any other Course communication, health data, other special-category data or data permitting the identification of a third party. The User is solely responsible for the lawfulness of disclosing such data, obtaining any necessary consent and ensuring anonymisation.

XIV. Complaints and Alternative Dispute Resolution

68.

The User may submit a complaint relating to the Course or the Service Provider's activities to the Service Provider using the following contact details:

a)

Email: support@sscamethod.com

b)

Postal address: HU-2141 Csömör, Mező utca 11.

69.

The Service Provider shall respond to a written complaint in writing, substantively and in a verifiable manner within the period prescribed by applicable law, generally within thirty days. It shall state the reasons for rejecting a complaint and provide information on the available remedies.

70.

A User qualifying as a consumer may refer a consumer dispute that has not been resolved directly with the Service Provider to a conciliation board for out-of-court resolution. The body competent on the basis of the Service Provider's registered office and, in a cross-border consumer dispute relating to an online service agreement, under the applicable law is:

a)

Pest County Conciliation Board

b)

Address: 1055 Budapest, Balassi Bálint utca 25. 4th floor 2.

71.

The User may also apply to the conciliation board competent according to the User's place of Hungarian residence or stay, or to another alternative dispute resolution forum designated under the mandatory rules applicable to the User. Commencement of conciliation board proceedings is conditional upon the User first attempting to resolve the dispute directly with the Service Provider.

72.

Use of conciliation board proceedings does not affect the User's right to bring proceedings before a court.

XV. Governing Law and Jurisdiction

73.

The Agreement, its interpretation and the rights and obligations of the Parties shall be governed by Hungarian law. Matters not regulated by these GTC shall be governed by the laws of Hungary.

74.

The Parties shall first attempt to resolve their dispute amicably. If such efforts are unsuccessful, the courts of Hungary shall have exclusive jurisdiction to determine the dispute.

XVI. Amendment of the GTC and Final Provisions

75.

The Service Provider may unilaterally amend these GTC with effect for the future, in particular due to a change in law, a decision of an authority or court, a change to the Course, Website, Software, payment system or technical system, a security reason or another reasonable cause affecting the Service Provider's operations.

76.

The Service Provider shall notify the User in a verifiable manner, before the amendment takes effect, of the material content and effective date of any amendment to the GTC affecting an ongoing Agreement. The User may terminate the Agreement within fourteen (14) days after becoming aware of such notice if the proposed amendment to the GTC contains a provision that is detrimental to the User.

77.

If any provision of these GTC is invalid, unenforceable or ineffective, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by the applicable provision of law.

78.

Provisions which by their nature are intended to survive shall remain in force after termination of the Agreement, including in particular the provisions relating to copyright, confidentiality, liability, fees that have already become due, governing law and disputes.

79.

An electronic communication between the Service Provider and the User shall be deemed duly made when sent to the email address or user account provided by the User. The User shall keep the User's contact details up to date.

80.

A message sent to the email address provided by the User shall constitute a written legal statement. The email shall be deemed delivered on the day it is sent, unless the sender receives a non-delivery report from the email system.
